FUNDAMENTAÇÃO A UMA EPISTEMOLOGIA DA JUSTIÇA

A presente dissertação trata de um estudo na área de Teoria e Filosofia do Direito e abarca dois autores principais; Imannuel Kant e John Rawls. As obras utilizadas neste estudo são as principais de ambos os autores, respectivamente a “Crítica da Razão Pura” (1781/1787) e “Uma Teoria da Justiça” (1971). O trabalho versará, com destaque, à teoria do conhecimento de Kant, pesquisando o que a filosofia transcendental pode dizer sobre a Justiça e, consequentemente, sobre o Direito no mesmo viés. A proposta é teórica e usa o método de reflexão abstrata para sugerir uma Fundamentação a uma Epistemologia da Justiça, tentando trazer à tona uma interpretação da realidade na qual o fenômeno jurídico não poderia ser outra coisa senão uma manifestação da própria Ideia de Justiça.

GROUNDWORK TO AN EPISTEMOLOGY OF JUSTICE

The following dissertation dwells within a study in the area of Theory and Philosophy of Law and has two main authors as reference; Imannuel Kant and John Rawls. The most famous and important works from those two authors are the ones chosen here as subjects of study, respectively, the “Critique of Pure Reason”(1781/1787) by Kant and “A Theory of Justice”(1971) by Rawls. As a main goal, the ‘theory of knowledge’ created by Kant and his ‘transcendental philosophy’ will be the most important foundation of this text as it will provide what the Pure Reason can say about Justice, and in this way, also about Law. There is a theorical proposition that uses the method of abstract reflation in order to bring up the ‘Groundwork to an Epistemology of Justice’, trying to provide an interpretation to reality in which the juridical phenomena could not avoid to be anything else but a practical manifestation of the Idea of Justice.
