ATIPICIDADE PENAL PELA INSIGNIFICÂNCIA: critérios e aplicabilidade na fase de inquérito

A presente dissertação busca fazer uma análise da postura a ser adotada pela Polícia Judiciária, em especial no que tange aos atos de ratificação da prisão em flagrante ou de indiciamento do investigado, quando constatada a pequenez da lesão ao bem jurídico tutelado pela norma penal. A ampliação das atribuições da autoridade policial possibilitando a apreciação do princípio da insignificância dentro da fase preliminar de inquérito, a despeito do que defendem alguns doutrinadores, busca preservar os direitos do suposto autor de crime, impedindo que este seja processado ou recolhido ao cárcere por fato que não enseja tal gravame.

IMMATERIALITY OF ACTION BY THE PRINCIPLE OF BICKERING: criteria and applicability in police procedure

This dissertation seeks to make an analysis of the real function of the judiciary Police, especially with regards to the acts of ratification of the arrest in the act or indictment of the investigated person when it is found that the injury to the legal asset protected by the criminal law is small, which has come to be known as “The Principle of Bickering”. The extension of the powers of the police authority, despite what some scholars defend, seeks to preserve the rights of the alleged perpetrator of a crime, preventing him from being prosecuted or taken to jail for a fact that does not require such burden.
